Accepting these terms

Helotes Drywall is a property of Trade Star Local, LLC, which operates this website ("we", "us", "our").

By using this site you agree to these terms. Use includes reading a page, submitting the form, and calling the number on it. If you do not agree, do not use the site.

If you are using this site for a company, a landlord or an HOA, you are confirming you have the authority to agree on their behalf. You must be at least 18 to submit a request.

What these terms cover

These terms cover this website and any request you send through it: the pages you read, the form you send, and the call you place.

They are not a contract for work at your property, and nothing on this site is one. Any work at your property is governed by its own separate written agreement covering what is being done, price, schedule, materials, change orders, payment terms and any warranty. If a detail matters to you, it belongs in that written agreement, not in an email, not in a phone call, and not on this page.

Nothing on this site is an offer, a quote, or a commitment to perform work. A price becomes a price when it is in that written agreement, and not before. Anything you read here about cost, timing or availability is general and subject to change.

How the work gets done. Work at your property is carried out by licensed contractors in our network, matched to your job by the work involved, where you are, and what they do. They are independent businesses, they carry their own licensing and insurance, and your agreement for the work is with the contractor who performs it. That agreement is separate from these terms.

No professional, code or legal advice

Everything on this site is general information about the work we do and the problems it solves. It is not advice about your property. It is not engineering advice, not legal advice, not a code determination, and not a substitute for a licensed professional looking at your specific situation.

Codes change. Cities and counties read them differently, and our service area crosses more than one of each. Your property, its age, its condition, and what has been done to it before all change the answer. Your city or county and its inspector decide what is permitted and what passes. This website does not decide it, and neither does an opinion given at the curb.

Where anything we describe touches a licensed specialty we do not hold, we say so and hand it on. Nothing on this site should be read as guidance on a trade we do not perform, and no page here tells you the condition of your own property. Only somebody looking at it can do that, and where a test is the only way to know, only the test decides.

Accuracy and availability

We try to keep this site accurate and current. We do not promise that it is. Content may be incomplete, out of date or wrong, and prices, code references and service details change without notice.

The site is provided "as is" and "as available." We do not promise it will be uninterrupted, error-free or secure, or that any defect will be fixed. We may change, suspend or discontinue any part of it at any time.

To the extent the law allows, we disclaim all warranties about this site and its content, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Any warranty relating to work performed at your property is a matter for the separate written agreement covering that work.

Using this site

Fair use of this site means: read it, call us, send a real request about a real property. Do not use it to:

• Submit false, misleading or someone else's information
• Send requests you do not intend to follow up on, or automate form submissions
• Scrape, crawl or harvest content or contact details
• Interfere with the site, probe it for weaknesses, or introduce malicious code
• Do anything unlawful, or anything that harasses anyone

We may refuse service, decline to act on a request, or block access at our discretion.

Requests and materials you send us

When you submit a request you confirm the information is accurate and that you have the authority to request work at the property you name.

Photographs and documents. You may send photographs of the area the work concerns, and you may send HOA standards or other documents. By sending them you confirm you have the right to, and you give us permission to use them to assess and carry out your request. Do not send anything confidential that you would not want handled by ordinary business email.

Nothing you send creates an obligation on us to take the work, and nothing we say in reply is a quote unless it is in the separate written agreement described above.

Consent to contact

When you submit the form or call the number on this site, you agree that we, the contractor matched to your request, and anyone acting on our behalf may contact you by phone, text and email about your request, including by automated or prerecorded call and by automated text.

Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.

How to stop. Reply STOP to any text, tell us on any call, or email [email protected] and we will stop. You may withdraw consent at any time and by any reasonable means. Calls may be recorded for quality and training.

Intellectual property

The text, layout, design, graphics, photographs and code on this site belong to Trade Star Local, LLC or to the people who licensed them to us. So do the Helotes Drywall name and logo.

You may read the site, print a page for your own use, and share a link. You may not copy, republish, resell or build a derivative site from our content without written permission.

Product names, place names, county names and agency names mentioned here belong to their respective owners and are used descriptively.

If you believe content on this site infringes your copyright, write to [email protected] with the details and we will look into it.

Third-party links and embedded services

This site links to other websites, including city permit pages, county pages and state agency lookups. Those sites are not ours. We do not control them, we do not endorse them, and we are not responsible for their content, their accuracy, or how they handle your information.

This site also embeds third-party services, including the estimate form and, on some pages, a map. Those are operated by their providers under their own terms and privacy practices, and information you enter into an embedded form is transmitted to that provider. Our Privacy Policy names them.

Limitation of liability

What these limits are about. They are about this website, its content and these terms. Liability relating to work at your property is governed by the separate written agreement covering that work, not by this page.

Contractors are independent businesses. A contractor matched to your request carries its own licensing and insurance and is responsible for the work it performs. To the fullest extent the law allows, we are not liable for a contractor's acts or omissions, including defective work, delay, damage to property, injury, code violations or a failed inspection. We are not a party to your agreement with a contractor.

We are not liable for indirect losses. That includes lost profits, lost data, loss of use, the cost of substitute services, and incidental, consequential, special or punitive damages. It applies even if we were told those losses were possible.

We are not liable for reliance on general information. Nothing on this site is a code determination, and a permit question, a code requirement or an inspection outcome is decided by your city or county and its inspector.

A cap on what we could owe. If we are found liable to you for anything arising out of this site or these terms, our total liability is limited to one hundred US dollars ($100).

Some jurisdictions do not allow certain exclusions or limits. Where that is the case, the limits above apply as far as the law permits and no further. Nothing here limits liability that cannot be limited by law, including for fraud, personal injury caused by negligence, or anything else that may not be excluded.

Indemnification

You agree to defend, indemnify and hold harmless Trade Star Local, LLC, Helotes Drywall, and our officers, members, employees and agents from any claim, loss, liability or expense, including reasonable attorney's fees, arising out of:

• Your use of this site
• Information, photographs or documents you submit through the site
• Your agreement, dispute or dealings with a contractor
• Your breach of these terms or of any law

Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.

Any dispute between you and us relating to this site or these terms will be brought in the state or federal courts located in Maricopa County, Arizona, and you and we both agree to those courts having jurisdiction.

The rest of it

If one part fails, the rest stands. If a court finds any part of these terms unenforceable, that part is limited or removed and the remaining terms stay in effect.

No waiver. If we do not enforce a term right away, we have not given up the right to enforce it later.

Whole agreement. These terms and the Privacy Policy are the entire agreement between you and us about this site. They do not replace or modify any separate written agreement covering work at your property.

Assignment. We may assign these terms to a successor or an affiliate. You may not assign them.

Survival. The disclaimers, limitation of liability, indemnification and governing law sections survive after you stop using the site.

Changes to these terms

We may update these terms. When we do, we change the "last updated" date at the top of this page. Continuing to use the site after a change means you accept the updated terms. If you do not accept them, stop using the site.
